The National Association of REALTORS® (NAR) said it reached an agreement with Phoenix REALTORS® that brings the local association into compliance with the NAR constitution and bylaws.
Phoenix REALTORS® has removed its MLS Choice option but will continue to offer ARMLS access to non-members, something the organization has done since 1996. However, the organization will be allowed to provide certain products and services via MLS Access, a non-member option.
Users who access the MLS through MLS Access are not members and cannot call themselves Realtors, NAR said.
“After working together productively, Phoenix REALTORS® and NAR have reached a mutually beneficial agreement that ensures Phoenix REALTORS’® non-member offering complies with NAR’s constitution, bylaws and the three-way agreement,” Phoenix REALTORS® said in a press release.
“Following NAR’s December 2024 cease and desist letter to Phoenix REALTORS® about MLS Choice, NAR initiated its charter revocation process, citing concerns that the offering conferred local association membership, caused confusion for consumers and weakened the Realtor brand,” the statement continued. “To address these concerns, Phoenix REALTORS® and NAR worked together to clarify the marketing around MLS Choice and introduce an updated offering.”
